GPT-CA Terms and Conditions

2.1 AI Chatbot Service

A conversational AI tool designed to deliver information about tax laws, legal matters, and compliance requirements. The AI chatbot uses machine learning models to generate responses based on user input.

2.2 Legal Database Service

A repository of legal materials, including laws, judicial decisions, and value-added content, for research and reference purposes (collectively, "Legal Content").

The Service is for informational purposes only and does not replace professional legal or tax advice. Users are advised to consult qualified professionals for specific decisions.

3.1 Compliance with Laws

Users agree to use the Service, including the AI Chatbot and Legal Database, in full compliance with all applicable laws and regulations. If any law restricts the use of the Service in a particular jurisdiction, users are not authorized to access or use the Service in a manner that violates such laws.

3.2 Prohibited Activities

Users shall not engage in any of the following activities while using the Service:

• Illegal or Fraudulent Use: Using the Service for any illegal, fraudulent, harmful, or abusive activities.
• Harmful Content: Generating content that may lead to harm, injury, unethical behavior, or the spread of misinformation. This includes attempts to create content fraudulently represented as human-generated.
• Abusive Content: Generating hateful, discriminatory, sexually explicit, graphically violent, or otherwise shocking/inappropriate material that is impermissible under applicable laws.
• Intellectual Property Violations: Submitting content that infringes on intellectual property rights or using any content without the necessary rights.
• Privacy Violations: Attempting to surface personal information of individuals, including phone numbers, addresses, or other sensitive data.
• Security Threats: Engaging in activities that attempt to disable, disrupt, or subvert the security measures of the Service, including bypassing content moderation and safety features.
• Reverse Engineering: Attempting to reverse-engineer, modify, decompile, or replicate the AI Chatbot, Legal Database, or any part of the Service to create competing AI models or services.
• Scraping and Unauthorized Data Collection: Scraping, crawling, or spidering any page, data, or portion of the Service via manual or automated means. Buying, selling, or transferring API keys with third parties is also prohibited.

3.3 Restrictions on Use of Legal Content

• Legal Content accessed through the Legal Database Service is provided for personal and non-commercial use only.
• Users may not reproduce, distribute, or exploit Legal Content without prior written permission from GPT-CA, except as permitted under applicable law.

3.4 Prohibited Use of Chatbot Responses

• Users may not use chatbot-generated responses to develop competing AI models, services, or derivative works without prior written consent.
• The chatbot must not be used to provide or solicit legal representation.

3.5 Accuracy of Service

Our Services are continuously evolving, and while we strive for accuracy, responses generated by the AI Chatbot may have mistakes and not always reflect real people, places, or facts. Users should exercise judgment and discretion when relying on chatbot-generated responses for any subsequent actions.

3.6 Enforcement and Consequences

Failure to comply with these terms may result in suspension or termination of access to the Service. Additionally, violations may be reported to relevant authorities, and legal action may be taken where necessary. The Company retains sole discretion in determining whether a user’s actions constitute a prohibited use and will enforce these terms in accordance with applicable laws.

Note: This list of prohibited activities is indicative and not exhaustive. The Company reserves the right to determine violations at its discretion.

4.1 Registration

Users must provide accurate and complete information during registration.

4.2 Account Security

Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.

4.3 Termination of Access

Failure to comply with these Terms may result in suspension or termination of user accounts.

5.1 Ownership

All content, features, and functionalities of GPT-CA, including chatbot responses, Legal Database Service, and Legal Content, are the exclusive property of GPT-CA or its licensors. Public domain judicial decisions remain public property; Legal content is covered as per applicable Indian Copyright Laws; however, any value-added enhancements or proprietary features provided as part of the Legal Database Service are the intellectual property of GPT-CA and are protected under applicable laws.

5.2 Limited License

Users are granted a non-exclusive, non-transferable, and revocable license to use the Service, including access to the AI Chatbot and Legal Database, in compliance with these Terms. This license is limited to individual, non-commercial use unless otherwise explicitly agreed in writing. Organizations seeking commercial use must obtain prior written consent from GPT-CA.

5.3 Use of Legal Content and AI Responses

• Legal Content, including laws and judicial decisions, is reproduced and made available in compliance with Indian copyright laws.
• AI-generated responses are provided for informational purposes only and must not be reproduced, distributed, or misused.

6.1 "As Is" Basis

The Service, including the AI Chatbot and Legal Database, is provided "as is" and "as available" without warranties of any kind, whether express or implied.

6.2 Disclaimer of Liability

To the fullest extent permitted by law, GPT-CA shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service, including reliance on chatbot responses or Legal Content, loss of profits, data, or reputation.

6.3 Third-Party Services

Our offerings may include third-party software, open-source software, or services ("Third-Party Services"). Both Third-Party Services and Third-Party Output are governed by their respective terms, and we disclaim any responsibility for them. Users acknowledge that they assume all risks associated with the use of such Third-Party Services.

Your use of GPT-CA is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Service, you consent to data practices described in the Privacy Policy. You can request for a copy of the privacy policy by sending an email to legal@gpt-ca.com.

We reserve the right to update these Terms at any time. Continued use of the Service after updates indicates acceptance of the revised Terms. Users are encouraged to review the Terms periodically.

9.1 By the Provider

We reserve the right to suspend or terminate access to the Service for violations of these Terms or at our sole discretion.

9.2 By the User

Users may discontinue use of the Service at any time.

10.1 Advisory Limitation

The Service does not provide personalized or professional legal/tax advice and should not be relied upon for making critical decisions.

10.2 Restricted Usage

Users are prohibited from using GPT-CA, including the AI Chatbot and Legal Database Service, to develop competing legal or tax advisory models or services.

10.3 Export Control Compliance

Users must comply with applicable export and re-export control laws when using GPT-CA.

10.4 High-Risk Activities

The Service is not intended for use in high-risk activities, including but not limited to life support, emergency services, critical medical systems, aviation operations, nuclear facilities, or any scenarios where errors or inaccuracies could result in death, personal injury, or any significant harm to individuals or property.

10.5 Maintenance and Support:

• GPT-CA provides remote technical assistance ("Support") through email or other methods as provided on our website. Users acknowledge and agree that response times may vary and that Support is provided without guarantees as to the resolution timeframe or outcomes.
• Users understand that GPT-CA may access user data and applications to correct or prevent issues but does not guarantee the absence of errors or full functionality on all systems.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved in the courts of Bengaluru, India.
